Injured During a Guided Tour

Question:
An employee returns to work on a Saturday (outside of regular working hours) with his family and several other people to participate in a guided tour of the workplace. During the tour, while walking down a flight of stairs, the employee falls and breaks an arm. Is it recordable?

Answer:
NO. Injuries that occur at work while the employee is present as a member of the general public is one of the OSHA recordkeeping exceptions.

1904.5(b)(2)(ii) You are not required to record injuries and illnesses if at the time of the injury or illness, the employee was present in the work environment as a member of the general public rather than as an employee.
