Company Gym Injury
Question: An employee is using the company gym during his lunch break when he accidently drops a 15lb dumbbell on his toes. He is seen at a clinic where an x-ray reveals a fractured toe. Pain medicine is prescribed along with work restrictions. Is it recordable?
Answer: NO. Even though the injury met recordable criteria in the bone fracture, prescription medicine, and work restrictions, OSHA has an exception for voluntary exercise injuries on the job.
1904.5(b)(2) Are there situations where an injury or illness occurs in the work environment and is not considered work-related? Yes, an injury or illness occurring in the work environment that falls under one of the following exceptions is not work-related, and therefore is not recordable.
